Legal Week’s sixth annual Trust and Estates Litigation Forum will unite the world's elite in the field of trust litigation to share, compare and contrast ideas and strategies for the decade ahead. Litigation involving investment funds has developed exponentially across the globe since 2008. Whether as a result of the fraud perpetrated by Madoff, the failings of fund directors (such as Weavering) or the overall economic meltdown, investors have found themselves holding shares that may variously be gated, suspended or sometimes worthless. Whilst much of this litigation has taken place onshore (primarily in the United States), the offshore world has been at the forefront. The Funds Litigation Forum will examine the issues presently being thrashed out by the Courts, how regulators have responded to the crisis and what the industry thinks lies ahead. Private equity backed companies have done much to justify the industry’s approach to continuing market turbulence. By demonstrating a level of flexibility and responsiveness not shown by listed corporates these companies are their private equity sponsors should feel cautiously confident when looking to their futures. Deal flow seems to be increasing with many transactions deploying novel structuring and increased levels of equity. Raising debt for new deals, however, remains stubbornly difficult. With both the European AIFMD and the US Dodd-Frank Act expected to impact significantly on business costs at both a holding and portfolio company level, private equity houses will be expected to become ever more flexible and forward thinking in their approach to investment and management. Outside of investment specific regulatory developments, ongoing shifts in corporate criminalisation, legal services provision and transparency requirements will all obviously impact upon legal advisers working within private equity. Legal Week Strategic Technology Forum is the annual meeting place for legal technology leaders. With the business climate continuously changing, firms must adapt and evolve in order to keep up. Day 1 of the Strategic Technology Forum will look at the likely challenges to such change and assess how best to surmount them. Success has often been linked with risk-taking, but in an industry where confidentiality and privacy is a pre-requisite, change and innovation can only occur when it is safe to do so.
