Welcome to the second annual Trust & Estates Litigation Forum. Following the resounding success of last years forum, Legal Week brings you another thought-provoking, interactive and highly enjoyable programme that will confront the challenges of this evolving industry.
Day one will begin with an assessment of the current contentious trust and estates environment lead by the honourable Mr. Justice Anthony Smellie QC. A panel of experts will examine recent high-profile cases to outline some of the new challenges faced in this niche industry. Delegates will hear how different jurisdictions are dealing with disputes and look at the factors that will affect the outcome of disputes in the future. An in-depth examination of capacity and undue influence will follow, helping the audience understand the myriad of aspects that influence the increase of these highly complex disputes.
‘Trusts and trustees under fire’ will form the first part of the discussion on day two. Justice Gavin Lightman will provide an objective view on the standards of propriety for trustees that will set the tone for three interactive focus group discussions on trustee removal, whether on retirement or via litigation, and the complications that result. The audience will also hear how institutional trust companies are responding to the attack on trusts with an outline of alternative trust models and a revision of the jurisdictions where they are held. To conclude the second day, delegates will learn how to approach cases involving the restitution of art when ownership has crossed into different jurisdictions.
The final day is designed to put into practice the knowledge gained from the programme with three case roleplays. Each session will be highly interactive, with all delegates taking an active role in deciding the case outcome. Attendees will be asked to select a case to participate in and will be presented with a summary of facts on arrival at the forum. The day promises to be an entertaining way for the higher echelons of this industry to share their knowledge and go away with new thought processes to embark upon future challenges.
